1. Scope
1.1 These Terms & Conditions (“Terms”) apply to all orders placed through the online shop tabaknova.ch (the “Shop”), operated by New Neptune GmbH (“we”, “us”).
1.2 We deliver exclusively to addresses in Switzerland and the Principality of Liechtenstein.
1.3 By placing an order, you accept these Terms in the version valid at the time of the order. Deviating terms of the customer are not recognized.
2. Age restriction (18+)
2.1 The sale of tobacco products, nicotine products, electronic cigarettes, and related goods to persons under 18 years of age is prohibited under the Swiss Tobacco Products Act (TabPG).
2.2 All products in this Shop are sold exclusively to persons aged 18 or over. By ordering, you confirm that you are at least 18 years old.
2.3 You confirm your age when entering the Shop (age gate) and when placing an order. We reserve the right to cancel orders where age cannot be verified and to request proof of identity at any time. Delivery may require an age check and adult signature by the carrier.
3. Products and offers
3.1 Product presentations in the Shop do not constitute a legally binding offer but an invitation to place an order.
3.2 Product images are illustrative and may differ from the delivered product. Technical changes by manufacturers remain reserved.
3.3 All products are intended for private use in customary household quantities. We may limit order quantities.
4. Conclusion of contract
4.1 By completing the checkout, you submit a binding offer to purchase the products in your cart.
4.2 The order confirmation email confirms receipt of your order only. The contract is concluded when we dispatch the goods or expressly confirm the order.
4.3 We may refuse orders without stating reasons, in particular where age verification fails, stock is unavailable, or there is reasonable suspicion of resale or misuse.
5. Prices
5.1 All prices are in Swiss Francs (CHF) and include Swiss VAT and, where applicable, tobacco tax.
5.2 Shipping costs are shown separately at checkout (see Section 7).
5.3 Obvious pricing errors may be corrected; in such cases you may cancel the order free of charge.
6. Payment
6.1 Accepted payment methods: TWINT and prepayment by bank transfer. Payment processing is handled by PostFinance Ltd, Switzerland.
6.2 The purchase price is due upon conclusion of the contract. For prepayment by bank transfer, goods are dispatched after receipt of the full payment. If payment is not received within 10 days, we may cancel the order.
6.3 We reserve the right to exclude individual payment methods for specific orders.
7. Shipping and delivery
7.1 We ship from our Swiss warehouse to Switzerland and Liechtenstein only.
7.2 Shipping costs are shown at checkout and depend on size and weight: small goods (up to 500 g, max. 5 cm thickness) CHF 5.90; parcels up to 2 kg CHF 9.00; up to 10 kg CHF 12.00; up to 30 kg CHF 21.00. Shipping is free for orders above CHF 65.
7.3 Delivery is made by Swiss Post and usually takes 3–5 working days after payment confirmation. You will receive an email confirmation as soon as your order has been dispatched. Stated delivery times are indicative and not binding deadlines.
7.4 Where required, delivery is made with age check on delivery (18+, signature required).
7.5 If a delivery cannot be completed (wrong address, not collected, age check failed), we may charge the resulting costs.
7.6 The risk of loss or damage passes to you upon handover of the goods to you.
8. Returns and refunds
8.1 There is no statutory right of withdrawal under Swiss law. Any return rights exist only as set out below.
8.2 We accept returns of unopened products in their original sealed packaging within 14 days of receipt, excluding the product categories in 8.3. Please contact us before returning goods. Return shipping is at your cost.
8.3 Excluded from return for hygiene, safety, and legal reasons: opened or unsealed products of any kind; tobacco products, e-liquids, vapes, and CBD products once the seal or packaging is broken; products with damaged packaging.
8.4 Refunds for accepted returns are made using the original payment method within 14 days of receiving the returned goods.
8.5 Defective goods: Please report visible transport damage immediately and defects within 5 days of discovery. Statutory warranty rights (Section 9) remain unaffected.
9. Warranty
9.1 Statutory warranty rights under the Swiss Code of Obligations apply for a period of two years from delivery.
9.2 In the event of a defect, we may choose to repair, replace, or refund. Further claims — in particular for damage caused by improper use, incorrect storage, or normal wear (e.g. coils, batteries) — are excluded to the extent permitted by law.
10. Retention of title
The goods remain our property until full payment has been received.
11. Liability
11.1 Use at your own risk: Tobacco, nicotine, vape, shisha, and CBD products are stimulants for adults and are harmful to health and addictive. By purchasing, you acknowledge these risks. The use and consumption of all products is entirely at your own risk and responsibility.
11.2 Manufacturer instructions: You must read and follow the manufacturer’s usage, safety, and storage instructions before using any product (in particular for batteries, chargers, e-liquids, and heating devices). We accept no liability for damage resulting from improper use, improper storage, modification of products, or failure to follow the manufacturer’s instructions.
11.3 Limitation of liability: To the extent permitted by law, our total liability arising from or in connection with an order is limited to the value of that order. Liability for slight negligence, indirect damage, consequential damage, and loss of profit is excluded.
11.4 Mandatory liability: The above limitations do not apply where liability cannot be excluded or limited by law, in particular for damage caused intentionally or by gross negligence, and for claims under the Swiss Product Liability Act.
